Notice of Rulemaking Activity

LSBN has been granted rulemaking authority in R.S. 37:918 to develop, adopt, and revise rules and regulations in the Louisiana Nurse Practice Act. Under the Administrative Code, Title 46 Professional and Occupational Standards, Part XLVII, Subpart 2. Chapter 34 entitled Disciplinary Proceedings: Alternative to Disciplinary Proceedings in which Section $3411, H. states "If the board finds that the public health, safety, and welfare requires emergency action and a finding to that effect is incorporated in its order, summary suspension of a license may be ordered by the executive director or designee pending proceedings for revocation or other action. Such proceedings shall be promptly instituted and determined at the next regularly scheduled board meeting". The insertion of the word available would allow the LSBN an opportunity to fulfill the request in a timely manner but without guaranteeing the issue will be heard at the next Board Hearing Panel. At present, LSBN's Hearings schedule is such that we are scheduling cases 2-3 months in advance. The additional word will provide clarity for the nurses in our state related to an emergency action meeting.

The first step in the rulemaking process is the publication of the Board's Notice of Intent in the July edition of the Louisiana Register. As of July 20, 2017 you will be able to access the publication free of charge at the state register's website at http://www.doa.la.gov/osr. The Notice of Intent can be found here.

The Board requests to receive written comments on the proposed revisions by August 10, 2017.
