Notice of Rulemaking Activity

The Louisiana State Board of Nursing in accordance with the provisions of the Administrative Procedure Act, R.S. 49:950 et seq., and through the authority granted in R.S. 37:918 is proposing rule changes to Chapter 33, Subchapter C, Subparagraph 3324.C and E under Title 46, Professional and Occupational Standards. Part XLVII. This proposed rule change will grant due process by allowing students who falsify their application or fail to disclose information to be judged on a case-by-case basis. Also, in Chapter 33, Section 3324. C "shall" will be changed to "may" in the following sentence: "Falsifying an application shall result in denial of permission to enroll in clinical nursing courses or application for licensure as a registered nurse in Louisiana for a minimum of five years". This will allow the Appointing Authority the flexibility to render a decision that is not aligned with a permanent action (s).

The first step in the rulemaking process is the publication of the Board's Notice of Intent in the April edition of the Louisiana Register. As of April 20, 2019, you will be able to access the publication free of charge at the state register's website at http://www.doa.la.gov/osr. The Notice of Intent can be found here.

The Board requests to receive written comments on the proposed revisions by May 10, 2019.
